Acceptance of Terms

By creating an account or using Hjertely (hjertely.dk), you agree to these Terms of Service. If you do not agree, please do not use the service. These terms form a binding agreement between you and Hjertely.

Hjertely is a private hobby project operated by an individual based in Denmark. It is not currently registered as a business (no CVR). If Hjertely becomes a commercial enterprise, this section will be updated with full company details.

Service Description

Hjertely is a digital wedding invitation platform. The service includes:

Creating personalized wedding invitations using our templates
Customizing invitations with photos, text, and design elements
Managing guest lists and collecting RSVP responses
Sharing invitations via unique personalized links
Sending email invitations to your guests
Uploading photos for use in your invitations

Pricing and Payment

Hjertely offers a free tier and a paid tier:

Free tier: Create invitations with up to 9 guests at no cost
Paid tier: For events with 10 or more guests, a paid plan is required
All prices shown on Hjertely include VAT (Danish moms)
Hjertely reserves the right to change pricing. Existing paid users will receive at least 30 days notice before any price change takes effect on their account
Payment is processed at the time of purchase. Details of the specific pricing are displayed before you confirm your purchase

Right of Withdrawal

Under the EU Consumer Rights Directive (Directive 2011/83/EU), you have the right to withdraw from a paid purchase within 14 days of the transaction, without giving any reason.

To exercise your right of withdrawal, send an email to support@hjertely.dk with your account details and a clear statement that you wish to withdraw
If you withdraw within the 14-day period, we will refund the full amount using the same payment method you used for the original purchase, without undue delay and no later than 14 days after we are informed of your decision
If you wish to begin using the paid service immediately (before the 14-day withdrawal period has expired), you may be asked to give explicit consent to immediate access. By doing so, you acknowledge that you will lose your right of withdrawal once the digital service has been fully provided
If you withdraw after consenting to immediate access but before the service is fully provided, you may be charged a proportional amount for the service already delivered

Hjertely is provided on an "as-is" basis. While we strive to keep the service running smoothly, please be aware of the following:

We do not guarantee any specific level of uptime or availability. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control
Invitation and event data may not persist indefinitely. Hjertely makes commercially reasonable efforts to maintain your data through your event date for paid users
You should maintain your own records of critical event information (guest lists, RSVP responses, event details). We recommend exporting or saving important data regularly
We may modify, update, or discontinue features of the service as we continue to improve the platform

Limitation of Liability

Hjertely is a digital invitation tool. Please understand the following limitations:

Hjertely is not responsible for the planning, execution, or outcome of your event. We provide a tool for creating and sharing invitations only
We are not liable for guest non-attendance, miscommunication between hosts and guests, event cancellation, or any other event-related issues
To the maximum extent permitted by law, Hjertely's total liability for any claim arising from or related to the service is limited to the amount you have paid to Hjertely in the 12 months preceding the claim
To the maximum extent permitted by law, Hjertely is not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of profits, or business interruption
Nothing in these Terms limits Hjertely's liability for damages caused by intentional misconduct or gross negligence, or for personal injury. These limitations cannot be waived under Danish law

Termination

Either party may end the use of this service under the following conditions:

You can terminate your account at any time by deleting your account through the service or by contacting support@hjertely.dk
If you breach these Terms, Hjertely may suspend or terminate your access. Except in cases of serious violations (such as illegal activity or security threats), we will provide reasonable notice and an opportunity to resolve the issue
In cases of serious violations, Hjertely reserves the right to suspend or terminate access immediately without prior notice
Upon account termination, your data will be deleted within 30 days, except where retention is required by law (e.g., financial records)
If Hjertely terminates your paid account without cause, you will receive a pro-rata refund for any unused prepaid period
If we decide to discontinue the service, we will provide at least 60 days advance notice via email to all registered users
Paid users will receive a pro-rata refund for any unused portion of their prepaid period
During the notice period, you will have the opportunity to export your data (guest lists, event details, uploaded photos)

Guest Data and Data Processing

When you add guest information to Hjertely, the following applies:

You (the host) are the data controller for the personal data of your guests. Hjertely acts as a data processor on your behalf
As the data controller, you are responsible for ensuring you have the right to share your guests' personal data (names, email addresses) with Hjertely for the purpose of sending invitations
Hjertely will only process guest data for the purpose of providing the invitation service, as described in our Privacy Policy
The relationship between you as data controller and Hjertely as data processor is governed by applicable data protection law, including the GDPR. For details on how we handle personal data, please refer to our Privacy Policy

Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes via email or through the service at least 14 days before the changes take effect. Your continued use of the service after changes take effect constitutes acceptance of the updated terms.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Denmark. Any disputes arising from or in connection with these Terms shall be subject to the jurisdiction of the Danish courts.

If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform to resolve disputes: https://ec.europa.eu/consumers/odr
Mandatory consumer protection rights under Danish and EU law apply regardless of any other provision in these Terms
You may also file a complaint with the Danish Consumer Complaints Board (Nævnenes Hus) via naevneneshus.dk
